Welcome to www.finsa.net (hereinafter referred to as the "Site". Any other link derived from the same will also be referred to as the "Site"). This page describes the general terms and conditions of access to the Site (hereinafter referred to as the "Terms of Use") which Finsa Holding, S.A. de C.V. and/or Finsa Inversiones I, S. de R.L. de C.V., and any other of the company's branches or subsidiaries (hereinafter referred to as "FINSA"), permits relative to general content as information, data, text, drawings, images, statistics, writs, music, news, graphics, video, photography, sounds, messages.

PURPOSE:  Through the access and use of the Site (www.finsa.net), FINSA offers and helps the User with access to the information of the services rendered by FINSA, which include, but are not limited to the following: (i) access to a search system over the available properties; (ii) information or links with description of the services offered; (iii) information or links with description of the products offered; (iv) location Map; (v) Placement Agency; and any other additional and/or specific service that in the future could be offered by FINSA to you (hereinafter referred to as the "User") through the Site (hereinafter, collectively referred to as the "Services"). 
ACCEPTANCE OF THE TERMS OF USE: The Terms of Use govern the access to and use of the Site (www.finsa.net) by the User and constitutes a binding agreement between Finsa and the User. 
In your capacity as the User, please slowly review the information contained in the mentioned Terms of Use.  All access to and use of this Site is governed by such terms.  The access to and/or the use of this Site indicates that the User has previously reviewed each and every one of the Terms of Use and has absolutely and unconditionally accepted such terms.  If the User does not accept the Terms of Use, he/she should abstain from using the Site.  In case the User continues to use the Site, such action will be considered as an absolute and unconditional acceptance of all the Terms of Use, including the following: 
a.  That the Content shown in the Site is, except otherwise stated, property of FINSA or is licensed for its incorporation to the Site. 
b.  That several reasons, such as, unforeseeable events and situations, force majeure or Acts of God, general computer and servers systems failures, amongst others, as well as for the malfunctioning or interruption of any other part of Internet could cause the obstruction of access to the Site and message transmission in this Site, errors in transmission of the same or temporary interruption of access to the Site, and that such circumstances are absolutely out of reach and control of FINSA. The User acknowledges that FINSA shall have no liability as result of such interruptions or obstructions 
c.  That the User is accessing the Internet under his/her own account and risk and at to his/her sole discretion.  FINSA, under no circumstances, is responsible for and does not guarantee the security or the integrity of any type of information on the Site.
d.  That, except otherwise established by the parties, the access and use of the Site by the User, does not construe, at any time, an authorization nor implicit or express license to use the intellectual property of the Site.
e. That the User agrees to use the Site pursuant to the law and in accordance with the Terms of Use.  The User is obliged to abstain from using the Site for illegal purposes or effects, contrary to those established in the Terms of Use, or with the intent to harm the rights and interests of third parties or with the intent to in any way harm, make unusable, or deteriorate the Site or to impede the regular use and enjoyment of the Site by other Users. 
f.  That the User will be liable for harm and damages of any nature that FINSA or its Subsidiaries suffer, directly or indirectly, as a consequence of the breach of any of the obligations of the Terms of Use or the law with respect to the use of the Site.
CHANGES IN THE CONTENT: Due to the open nature of Internet, we constantly change and modify the content, structure and services we offer in the Site, including the Terms of Use.  Upon accessing or using this Site, the User understands and accepts that FINSA will have, at any time, the right to carry out such modifications and updates without previous notification.  Therefore, the User expressly accepts that it is his/her obligation to periodically review the Terms of Use of the Site.  You, as the User, can review the Terms of Use, by accessing them in the lower part of each page of the Site.  The access and use of this Site by the User after the publication of any change in the Terms of Use unequivocally indicates that the User absolutely and unconditionally accepts such changes and/or updates. 
LIABILITY LIMITATION:  Notwithstanding the efforts to make this Internet Site be comprehensible and precise, due to the open nature of Internet and the potential errors or failures in the storage or transmission of digital information, FINSA does not guarantee the accuracy of the information obtained in this Internet Site.  FINSA DOES NOT GUARANTEE THAT THE FUNCTIONS CONTAINED IN THIS SITE WILL BE UNINTERRUPTED OR ARE ERROR FREE, THAT THESE FAILURES WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER DOES NOT HAVE ANY VIRUS OR ANY OTHER HARMFUL COMPONENT.  FINSA will not be liable, in any case, for any harm or damage that, in any form, is derived from or is related to: (i) the access, use or execution of this Site and its Services; (ii) the delay or use availability failure of the Site; (iii) the furnishing or lack of furnishing of information or graphics contained or published in or through the Site, (iv) the update or lack of update of the Content; (v) the modification or alteration of Content on the Site; and (vi) any other aspect or characteristic of the Content published in the Site or through the links that will be included to the same eventually.  Notwithstanding that the Content of this Site is considered exact, it is possible that it contains technical inaccuracy or typographic errors. FINSA will make an effort to update the Content of the Site in a constant manner.  FINSA does not guarantee that the Site will satisfy the requirements of the User, or that the Services will be maintained uninterrupted, safe or error free.  
INFORMATION ACCESS AND USE: The access to this Internet Site is limited to viewing its pages or other Internet sites linked to it only for the purposes of legitimate businesses.  Any access or intention to access other areas or segments of the computer system of the Site or any other information contained in our computer systems and data storage for any purpose is strictly prohibited.  Without prior written authorization from FINSA, the User shall not use any information contained in this Internet Site for business purposes User acknowledges that the use of the information contained in the Site is at the User's sole risk.
SEARCHES: The User can use the Site's Search Engine and review the description of the specific product or services, including detailed information or photographs, if same are available.  The User will have the obligation to verify the availability and characteristics of the Services with FINSA's personnel.  The User acknowledges that FINSA is unable to maintain accurate and updated information of the Services.  The information contained in the Site is considered trustworthy.  HOWEVER, FINSA DOES NOT EXPRESSLY OR IMPLICITLY GUARANTEE THE ACCURACY OF THE INFORMATION OF SERVICES CONTAINED OR DESCRIBED AS AVAILABLE IN THIS SITE (WWW.FINSA.NET). 
ONLINE SERVICES: The User can send information to the Placement Agency and Suppliers through the Site.  In this regard, he/she recognizes that by sending information through the Site: a. All statements and information furnished by the User in the Site shall be true, exact and complete. The User is expressly obliged to update such information, with the purpose of guaranteeing that the same continues to be valid, correct and exact at all times; b. That he/she is of the age of majority and has the sufficient and necessary legal capacity to perform the activities represented; c.  He/she is absolutely responsible for the use of any access code, provided by FINSA to the User in the Site; d. He/she authorizes FINSA to integrate the data and information sent through the site in the database of FINSA; e. FINSA will not have the obligation of integrating, publishing, transmitting, reproducing, divulging the information of the User; f. That the possibility to send information by the User through the Online Services, including the placement agency, the suppliers or subcontractors sections, amongst others, is not and should not be considered as an offer or request by FINSA and that FINSA therefore, will not be obliged, to contract or accept services, or products of the User; g. Any data or information of the User provided to FINSA may be furnished to the competent authorities that request such; h. He/she expressly authorizes the use of technological means, including fax and electronic mail, for the sending and delivery of documents and information related to FINSA. 
INTELLECTUAL PROPERTY:  The User acknowledges that the Content, including, but not limited to, information, data, text, drawings, images, statistics, writs, computer programs, files, graphics, video, photography, sounds, messages, is protected by copyrights, distinctive signs, patents and any other rights, including those derived from the intellectual property laws and international treaties.  The reproduction, modification, distribution, transmission, republication, exhibition or execution of the Content of the Site without the express written permission from FINSA or its titleholders is strictly prohibited.  "FINSA", "Desarrollando Grandes Ideas" and "Developing Great Ideas", are distinctive signs registered in Mexico and other countries. This Internet Site contains several trademarked properties of FINSA and third parties.  All of the trademarks are property of their corresponding titleholders.  Statements regarding any third party and/or its name, trademark, product or services do not constitute, nor imply marketing or recommendation of such third parties or their products or services.  Access to the Services in this Site, shall not be deemed at any time as an authorization or license (whether implicit or explicit) to use the intellectual property of the Site.  All the intellectual property rights contained in this Internet Site, including but not limiting to, copyrights, trademarks and patent rights are reserved.  The access to this Internet Site shall not be deemed to grant the right to copy or use in any form or any way, such intellectual property. 
HYPERTEXT LINKS:  This Site can be linked to other sites that are not managed by FINSA.  FINSA is not responsible for the content of such sites.  The inclusion of any link to such sites does not imply the concordance, sponsorship or recommendation by FINSA of these sites.  FINSA is not liable, and shall not incur any obligation or responsibility as a result of the links: (i) of other Internet sites to www.finsa.net; and (ii) to other Internet sites from www.finsa.net.  To link to www.finsa.net, all Users must comply with the Terms of Use.

All the materials contained in this Site are subject to FINSA's intellectual property rights.  FINSA authorizes you, in your capacity as User, to make a single copy of the content herein contained, exclusively for the use of evaluating and acquiring the Services mentioned in the Site.  The User is obliged that any copy made must include the copyright legend of the Site.  No other permission is granted to print, copy, reproduce, distribute, transmit, upload, download, save, show in public, alter or modify in any way or form the content of this Site. 
ACCEPTANCE:  All the observations, suggestions, ideas, graphics or any other information addressed to FINSA through this Site will be considered as divulged information and, therefore, of public domain.  You, as a User, recognize and expressly acknowledge that by communicating to FINSA any suggestion, idea, image or any other information, you will be authorizing it to use such information as it may deem convenient and without any consideration.  FINSA will not be obligated to consider the information as confidential.  The site can collect several types of information from Users.  The Internet Site's server collects general information pertaining to each visitor to the Site, including the IP domain, domain name, Internet page, time in the Site, and the pages to which the User had access while visiting the Site. Some of the reasons that this information is obtained, include: to obtain statistical information, ease the management system and improve the content of the Site.  FINSA can also retain the content of all the electronic communications that are received by and sent to the Users and their representatives. This information helps FINSA to respond to the questions and comments of the visitors of the Site. 
SECURITY:  FINSA employs extreme security to protect the information transmitted through this Site and will take the maximum security measures to protect such information.  However, FINSA does not guarantee that all of the operations and electronic transmissions are totally safe.  FINSA will attempt to protect all the specific information of the User from loss, misuse and alteration. 
SERVICES SUSPENSION: FINSA, at all times and without any prior notice or liability, will have the right to temporarily suspend operations and/or Content of the Site. 
PRIVACY POLICY: The User authorizes FINSA to use the information obtained from the Site and include it in its databases, amongst others, to improve its services to its clients.  FINSA may also use the collected information to notify the Users of the Site of changes to same, to notify its visitors of new Services available through its Site, and for any other legally commercial purpose.  Likewise, FINSA may opt to exchange information with third parties.   However, the User of the Site may request that its information not be exchanged by requesting same through an electronic mail to the following e-mail address from each electronic address that the User has used and provided to access the Services of the Site: info@finsa.net.  By freely furnishing personal information to the site, you, as the User, expressly grant FINSA the right to use it as previously described. 
SUBSCRIPTION OPTION: The User of the Site can opt to omit the delivery of publicity, through electronic mail, by simply requesting it via an electronic message to the following address: info@finsa.net.  The User should send a separate request for each electronic mail address to which the request pertains. 
APPLICABLE LAW; LIMITATIONS: The User expressly recognizes and accepts that all the operations carried out through the Site, regardless of the place from which the User is accessing such Internet Site, shall be deemed to have occurred in Mexico, and therefore the law of the United Mexican States shall govern usage of the Site.  All the applicable terms and conditions of the Site will be interpreted and executed exclusively pursuant to the Commercial Code of the United Mexican State and the provisions of the Federal Civil Code and applicable procedure provisions of the Commercial Code and the Mexican laws that supplement such.  Any cause of action with respect to any operation made in the Site will legally lapse, if the same is not brought by the interested User within 12 (twelve) months following the date in which the cause of action arises.  The provisions of Conventions and International Treaties shall not be applicable.   
DISPUTE RESOLUTION: The parties agree that all controversies or disputes that result by the interpretation, execution or breach of the Site's Terms of Use, will be definitively resolved by competent civil courts located in the City of Monterrey, State of Nuevo Leon, Mexico.  The parties waive any other jurisdiction to which they could otherwise be entitled due to domicile or any other cause.
